If your building was built before 31 December 1989, your body corporate must:
• Keep an asbestos register for whole properties if it is commercial or industrial and for common areas, only, of a residential property like units and townhouse developments
• Have an asbestos management plan if asbestos is present
• Inform contractors and workers about asbestos before work starts
• Use only licensed professionals for asbestos removal and obtain clearance certificates
These duties fall under the Work Health and Safety Act 2011 and are designed to protect workers, residents, and visitors.

In Queensland, under the Work Health and Safety Regulation 2011:
• An asbestos register is required for any workplace or building built before 31 December 1989, unless you have written evidence that no asbestos is present. For Body Corporates, this applies to common property areas such as foyers, stairwells, plant rooms, service ducts, and car parks.
• An asbestos management plan is required if asbestos is identified or assumed to be present. The plan must outline how the asbestos will be managed, monitored, and safely maintained or removed.
• Both documents must be kept current and made available to workers, contractors, and anyone who may be at risk of exposure.
Failing to maintain these documents is a legal breach and can result in penalties. Keeping them up to date ensures compliance and protects residents, contractors, and visitors.

A licence is not required to remove ten square metres or less of non-friable asbestos, however, a person conducting a business or undertaking (PCBU) must do the work in accordance with Part 8.7 of the Work Health and Safety Regulation 2011. Homeowners must hold a certificate obtained under arrangements approved or established by the Department of Health to remove more than ten square metres of non-friable asbestos materials.
